At GE Canada Equipment Financing G.P. and our Canadian affiliates forming part of the GE Capital group ("GE Capital"), protecting your privacy is very important to us. Our goal is to treat the personal information you furnish us with the utmost respect in accordance with this Privacy Policy and applicable law. Please read on for details about our practices for handling and securing your personal information.
CONSENT
BY SUBMITTING PERSONAL INFORMATION TO GE CAPITAL OR ITS AGENTS, YOU AGREE THAT WE MAY COLLECT, USE AND DISCLOSE SUCH PERSONAL INFORMATION IN ACCORDANCE WITH THIS PRIVACY POLICY AND AS PERMITTED OR REQUIRED BY LAW. Please note that when you provide your personal information to us in a request for one of our products or services, more specific details on how we may use and treat that information may be provided with the request, in which case your personal information may be used in accordance with any further consent we obtain from you.
1. Information Collected
1.1 What personal information do we collect?
Also, we may gather similar additional information from our affiliates and third parties (including credit reporting agencies, other financial institutions, creditors, vendors and other persons) to determine your eligibility to receive our products and services. At times, we also conduct surveys to better understand the needs, profiles, and experience of our customers. You will be given the option of not participating in such surveys. Please note that we do not knowingly solicit information from children and we do not knowingly market our products and services to children.
1.2 Why do we collect your personal information?
(a) To provide the product, information or service you requested
If you are a customer, we may use your personal information for the purposes of: i) investigating and/or verifying all credit, financial and other personal information about you related to your identity, credit rating, financial capacity and payment history; ii) processing a request for financing and any future such requests; and iii) completing, servicing and enforcing any resulting transactions (if approved and executed). By obtaining as accurate a credit profile of you as possible, we are able to offer our credit services more efficiently.
(b) To improve and develop existing and additional products and services
We may also use your personal information for the purpose of: i) improving our existing and developing additional products and services; and ii) better understanding the needs, profiles and experience of our customers.
(c) To send you information about products, information or services
From time to time we may send you further information about our products and services that may be of interest to you.
(d) Other purposes
In addition, from time to time, we may use your personal information for the following purposes:
- To detect and protect GE Capital and other third parties against error, fraud, theft and other illegal activity, and to audit compliance with GE Capital policies and contractual obligations
- To engage in business transactions, including the purchase, sale, lease, merger, amalgamation or any other type of acquisition, disposal, securitization or financing involving GE Capital
- For any other purpose to which you may consent from time to time
Please note that information such as aggregate information or "blind" data without personal identifiers may be used for business purposes other than those identified above and we may share such non-personal information with third parties.
2. Use of your information
2.1 To whom do we disclose your personal information?
We may disclose your personal information to the following third parties in the following circumstances:
Disclosure to Service Providers
We may disclose your personal information to other companies that provide services on our behalf, including our authorized international truck dealers, equipment appraisal companies, our auditors, third party marketing solicitation companies, acting on our behalf, collection agencies, bailiffs, software developers, data processing, document management and office services (such as shredding, cleaning and security companies). In addition, we may respond to inquiries from, and exchange personal information with, third parties (including credit reporting agencies, other financial institutions, creditors, vendors and other persons) in order to evaluate your credit rating, financial history and payment history, or to collect debts outstanding on an account. We will only provide those companies the information they need to deliver the service and they are prohibited from using that information for any other purpose.
Disclosure to Affiliates
We may disclose your personal information to any of the companies and business entities that form part of the GE Capital group, to the General Electric Company or to any direct or indirect subsidiary thereof, in order to fulfill the purposes set forth above and to provide you with information about our affiliates’ products and services.“You hereby acknowledge that the personal information you provide GE may be processed and stored in the United States and that United States governments, courts or law enforcement or regulatory agencies may be able to obtain disclosure of your personal information through the laws of the United States.”
Disclosure to Business Partners
From time to time we may make our list of customers available to other carefully screened organizations that want to let you know about a product or service that might interest you. The material to be sent to you is reviewed by us before the names and addresses (including e-mail addresses) are released to ensure the company is reputable and their materials are appropriate and not misleading.
Disclosure to Customer Representatives
There are circumstances in which we may receive requests to share your personal information with a third party who is not GE Capital’s service provider or affiliate (for example, your representative, relative, accountant, etc.). GE Capital will not share your personal information with such individuals or organizations without your prior, written authorization.
Disclosure in Business Transfers
GE Capital may be involved in the sale or transfer of some or all of its business. As part of that sale or transfer, GE Capital may disclose your personal information to the acquiring organization, but will require the acquiring organization to agree to protect the privacy of your personal information in a manner that is consistent with this Privacy Policy.
Law Enforcement and Legal Disclosure
GE Capital may disclose your personal information to a government institution that has asserted its lawful authority to obtain the information or where GE Capital has reasonable grounds to believe the information could be useful in the investigation of unlawful activity, or to comply with a subpoena or warrant or an order made by a court, person or body with jurisdiction to compel the production of information, or to comply with court rules regarding the production of records and information, or to GE Capital’s legal counsel.

2.2 How can you let us know about your privacy preferences?
At GE Capital, we want you to be able to maintain control over how we use your personal information. In particular:
- You always have the option to instruct us not to use your name, address, e-mail address, etc. beyond providing you with the product, information or service you requested.
- You may "opt out" of participating in surveys, described above, that are designed to better understand the needs, profile and experience of our customers.
- E-mail communications we send to you regarding our products and services will always include an identification of the sender and an "unsubscribe" option.

3. Safeguarding
3.1 Where is your personal information stored?
Your personal information is stored in secured locations and on servers controlled by GE Capital, located either at our offices or at the offices of our service providers. For access to your personal information, please contact our Chief Privacy Officer via the contact listed in the Questions & Complaints section.
3.2 How long do we keep your personal information?
We keep personal information about you only as long as we need it to fulfill the purposes for which it was collected or to meet any legal and audit requirements. We have retention guidelines that meet these requirements.
3.3 How do you access and update your information?
You may access and notify us to update the personal information you have provided to us by contacting your local GE Capital branch, by sending us an e-mail at infoprivacy@ge.com or by calling us at 1-877-909-1999.
You may also request that we discontinue maintenance and use of your personal information for the permitted purposes. Such a request, however, may not be completed until there are no longer any remaining obligations between us. Your request may also result in the termination of your relationship with us.
There’s no charge for verifying or correcting information about you. Depending on the circumstances, there may be a charge if you want a copy of records that we have already given you. We will inform you beforehand of any applicable charges.
3.4 How is your information secured and protected?
To help protect the confidentiality of your personal information, GE Capital employs physical, technological and procedural safeguards appropriate to the sensitivity of your personal information, in accordance with applicable law and industry standards. Where personal information is collected by a third party on our behalf or where it is sent to a third party for processing, we establish contractual and technological safeguards to help ensure that all such information is kept secure. We operate secure data networks protected by industry standard firewall and password protection systems.
Where GE Capital considers it appropriate, GE Capital uses encryption and/or authentication tools among other methods to protect your personal information. E-mails you send us are not necessarily secure when they are transmitted to us. If your communication is sensitive or includes confidential information such as a credit card number, you may want to provide it by post or via the telephone instead.
We instruct our employees with access to your information that it is to be used only in adherence with the principles set forth in this Privacy Policy and the laws applicable to each specific business. Employees who misuse customer and other personal information may be subject to disciplinary action.
4. Websites
Anonymous Browsing – You can visit GE Capital websites without telling us who you are or revealing any information about yourself. In this case, our Web servers may collect the name of the IP address you used to access the Internet and the website you came from and visit next. This information is used by us and our business partners to measure the number of visits, average time spent, page views, and other statistics about visitors to the GE Capital websites in general. We may also use this data to monitor site performance, for systems administration purposes, to make the GE Capital websites easier and more convenient to use and to report information in aggregate form to our advisers (e.g. how many visitors log in to the GE Capital websites).
Cookies – When an individual visitor accesses the GE Capital websites, we may use a browser feature called a ‘cookie’ to collect information such as the type of Internet browser and operating system the visitor uses, the domain name of the websites from which the visitor came, date and duration of the visit, number of visits, average time spent on our websites, pages viewed and number of cookies accumulated. A cookie is a small text file containing a unique identification number that identifies the visitor’s browser, but not necessarily the visitor, to our computers each time our websites are visited. Unless a visitor specifically informs us (e.g. by enrolling for our services or sending us correspondence from the websites), we will not know who the individual visitors are. In addition to the identified purposes described in our Privacy Policy, we may use this website information and share it with other organizations with whom we have a commercial relationship to measure the use of our websites and to improve the functionality and content of the websites. Visitors can reset their browsers either to notify them when they have received a cookie or refuse to accept cookies. However, if a visitor refuses to accept cookies, he or she may not be able to use some of the features available on our websites.
Tracking Preferences – At the GE Capital websites, we may use your personal information to track your preferences. Tracking user preferences also helps us serve you targeted advertising. Targeted advertisements are probably more interesting for you and are more productive for our advertisers. Please note that we do not share your personal information with advertisers.
Online Communications – In order to provide our website visitors with a product, service or information, visitors may voluntarily submit personal information to us for purposes such as asking a question, obtaining information, reviewing or downloading a publication, participating in contests and surveys. If you are known to GE Capital as a registered user of an online service, we may combine and store personal information about your use of our websites and the online information you have provided with certain other online and offline information we may have collected.
E-mail Communications – If you send us an e-mail message, we may retain that message and your e-mail address, as well as any response we send you. In addition, occasionally, we may send marketing or promotional e-mail communications to you with information that may be useful, including information about the services of GE Capital and other third parties with whom we have a relationship. We will include instructions on how to unsubscribe and inform us of preferences if recipients decide they do not want to receive any future marketing or promotional e-mails from GE Capital.
Advertisers – If you submit your name through a form on any GE Capital site to request information from an advertiser or other third party, we are not responsible for any marketing or other use of your name by the third party. To learn more about any other company or organization's privacy policies, we suggest visiting its website or contacting it by postal mail or telephone.
Searches – Keyword search functions are provided on our websites as a convenience to our users. We do not collect your name or e-mail address as a result of using a search feature. We may keep logs of all words searched to help us learn what kinds of information our visitors are seeking, and to improve our service to visitors.
Links – Our websites may contain links to other websites that are provided as a convenience only. Visitors are advised that other third party websites may have different privacy policies and practices than GE Capital, and GE Capital has no responsibility for such third party websites.
5.1 How do you find out more about our Privacy Policy?
If you have questions, concerns or complaints regarding our collection, use or disclosure of your personal information or if you would like more information about our privacy practices, please call us at 1-877-909-1999. In addition, in order to continually monitor and strengthen our privacy procedure, we have on staff a Business Privacy Manager and a Chief Privacy Officer who is the General Counsel for GE Capital. 5.2 What if we change our Privacy Policy?
GE Capital reserves the right to modify or supplement this Privacy Policy at anytime. If we make any material change to this Privacy Policy, we will notify you by posting such changes on the GE Capital websites. Please read any such notice and the new policy statement. Your continued use of our services after we have notified you of changes will constitute your acceptance of the new terms, and such terms will henceforth apply to information previously furnished to us, as if they were the initial terms. However, we will seek your consent if we want to use your personal information for purposes other than those you have agreed to previously.
6. Our Commitment: Adhering to the 10 Privacy Principles
In Canada, "Fair Information Practices" as regards your personal information are reflected in a series of 10 privacy principles developed by the Canadian Standards Association and incorporated into Canadian privacy legislation such as the federal Personal Information Protection and Electronic Documents Act ("PIPEDA"), designed to ensure that companies treat your personal information fairly, protect its confidentiality and provide the means by which individuals can maintain a reasonable level of control over how their personal information is collected, used and disclosed. At GE Capital, our commitment to you is to collect, use and disclose your personal information by employing "Fair Information Practices" as described in the following 10 privacy principles:
Principle 1 – Accountability
GE Capital is responsible for personal information under its control and has designated a Business Privacy Manager and a Chief Privacy Officer who are accountable for GE Capital’s compliance with this Privacy Policy and the applicable privacy legislation. Contact information for the Business Privacy Manager and Chief Privacy Officer is provided in the Questions & Complaints section of this Privacy Policy. In addition, our accountability for the personal information we collect continues even if we disclose it to other organizations. For example, whenever we disclose your information to another organization (such as to one of our service providers), we will put in place contractual and other safeguards to help ensure that they appropriately protect your personal information.

GE Capital will not routinely update personal information, unless such process is necessary to fulfill the identified purposes. If ever your contact and/or other personal information changes, please feel free to contact us, so that we can update our records.
Principle 7 – Security Safeguards
GE Capital will protect your personal information by security safeguards appropriate to the sensitivity of the information. For example, the computer servers on which we store your personal information are protected by firewalls and other industry standard security features. In addition, your personal information is only made available to our employees and service providers who have a "need to know" in order to offer you our services or otherwise fulfil the purposes identified above.
